TERMS AND CONDITIONS OF SALE AND DELIVERY

1. VAT

All prices shown on our website include VAT in Spain. The customer will always specify at the time of purchase if the billing information should be different from the delivery, for example if it is a company. This must be specified from the beginning, as after the purchase no changes will be made to the invoicing other than those that have not been specified before the time of purchase.

 

Our company outside Spain does not sell to companies, only to individuals, as our system is fully automated and does not have a system of intra-community CIF recognition. Therefore, all purchases to be made outside Spain will only be invoiced to individuals.

 

2. TRANSPORT COSTS

  • In the Peninsula
    • The cost of transport to the peninsula will have a generic cost of 12.90€.
    • The amount will vary depending on the weight and overall dimensions of the order.
  • In the Balearic Islands
    • The cost of transport to the Balearic Islands will have a generic cost of 16.90€. The amount will vary depending on the weight and overall dimensions of the order.
  •          
  • In the Canary Islands, Ceuta and
      Melilla              
    • All products shipped to the Canary Islands, Ceuta and Melilla will have a shipping cost of 145 € (there will be other products in which the shipping cost will be higher depending on the weight and size of them
    • ).
  • In Portugal (excluding Madeira and Azores)
    • Products with a pricelower than 300 € will have a shipping cost of 35 €.
    •                  
    • There will be some special products, which despite having a price over 300 € will be charged shipping costs, which will be detailed before making the purchase depending on the product. There will also be other products in which the cost of transport will be higher depending on the weight and size of the same
  • In Madeira,Azores, Canary Islands, Ceuta and Melilla
    • All products shipped to Madeira, Azores, Canary
    Islands, Ceuta and Melilla

    • Shipping costs will be 45 € for any product.

3. DELIVERY TIME

                           
  • Urgent Transport (departures from our warehouse). delivery time 24-48 hours working days, according to locality Courier Transport.
  • Normal Transport 3-7 working days. Transport by Agency withdepartures from manufacturer or distribution*.
           

*Except for reasons of force majeure the months of March, April, May, June and July high season, dates that may exist:

                           

Immediate breakage of stock without our system detecting it at the time of completion of the purchase. In this circumstance the product will not be able to be served in an automated way until there is no stock again.

                           

Collapse in manufacturer or distribution warehouses due to excess orders, including collapse in non-courier transport agencies (in this circumstance the product may take up to 10 working days to be delivered and may not even be served).

                           

IMPORTANT to send the goods to an address where there is always someone to be picked up, it is correct and does not give rise to confusion.

                           

Due to multiple factors (dimensions of the goods, value, fragility...) we do not deliver to collection points, lockers, parcel boxes or any other system of temporary reception of parcels and shipments . In the event that the delivery address provided by the customer is one of the aforementioned elements, JARPIS SL is exonerated from any liability and we will not process any claims relating to transport.
                           
                           Jarpis, S.L. will not be held responsible in the event of incorrect delivery to the wrong place due to: out-of-date or modified address, duplicate addresses at the same delivery address. All this responsibility falls on the buyer of the goods, who is the person who indicates in the purchase process, the shipping address of the goods and also has a field of additional notes to reflect more specific addresses.

                           

As soon as the goods leave our warehouse we will issue an invoice, which you will receive by e-mail and you will also receive the name of the transport agency and the tracking number of your order.

                           

You will also be able to find your tracking number on our website in the Shipping Tracking section , by entering your email address and order number.

                           

 

                           

4. DELIVERY TIME SPECIFICATION

                           

We recommend that you specify an address (e.g. work address or a neighbour's address) where there is someone to whom the parcel can be delivered.

                           

 

                           

5. RECEIPT OF PRODUCTS

                           

If one or more products have arrived damaged due to transport, this must always be indicated on the delivery note signed by the carrier upon receipt of the order, after which you will have 24 to 48 hours to notify the carrier. If the notification is not made within the indicated period, Jarpis, S.L. will not be held responsible for any damage caused by transport.

                           

If there is any damage and it has been notified in a timely manner, we will bear all extra transport costs that may arise, provided that the product has not been used, altered or tampered with and is in its original box and seal.

                           

Please note that in order for us to be able to process any exchange or return it is essential that you contact us beforehand. We will not accept any exchange or return if we have not received prior notification.

                           

The delivery of bulky or special handling products will be delivered by the carrier to the street. If special means are required to deliver inside housing, terrace or concrete places, it will have to be required and paid by the own client and of external and foreign form to Piscinayspa.

                           

NOTE Verification of goods: It is important to verify the state of your purchase at the moment of reception and, if you notice any damage supposedly caused by transport, indicate it on the delivery note when signing it.
                           
NOTE Commercial Advice: It is important to check the manual tab of the product's different commercial information before ordering in order to fully verify the suitability of the product you are buying for each use. Since Jarpis, S.L, is not responsible for the suitability of the product for each case in the place that there was a commercial advice or misunderstanding between our agents and the final buyer.
                           
NOTE Special taxes. Cities and areas with special taxes (in the case of Spain: Canary Islands, Ceuta and Melilla) will be taxed according to their corresponding tax. This tax must be paid by the final customer or recipient of the goods according to local customs laws.

                           

 

                           

6. RECEIPT OF INCORRECT PRODUCTS

                           

If one or more products received do not correspond to your order, we will send you the correct products or refund the corresponding amount. We will bear all extra transport costs that may arise, provided that the product has not been used, altered or tampered with and is in its original box and seal.

                           

 

                           

7. RETURN

                           

Right of withdrawal

                           

You have the right to withdraw from this contract within 14 calendar days without giving any reason, provided that the product has not been used, altered or tampered with and is in its original box and seal.

                           

The withdrawal period will expire 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired the material possession of the goods.

                           

To exercise the right of withdrawal, you must notify us at the email address incidencias@piscinayspa.com, your decision to withdraw from the contract through an unequivocal statement by attaching the following withdrawal form duly completed (or failing that including in the email the data requested therein).

                           

In order to comply with the withdrawal period, it is sufficient that the communication concerning your exercise of this right is sent before the expiry of the withdrawal period.

                           

Consequences of withdrawal

                           

In the event of withdrawal on your part, we will refund all payments received from you, except delivery charges without undue delay and in any event not later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We must withhold reimbursement until we have received the goods back, or until you have provided proof of return of the goods, whichever condition is met first.

                           

You must return or deliver the goods directly to us or hand them over to us at the address we give you after we receive your decision to withdraw from the contract, without undue delay and in any event not later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract to us. The deadline shall be deemed to have been met if you return the goods before this period has expired. You shall bear the direct cost of returning the goods. You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

                           

Before sending us any product for return, we need you to send us photos of the product and its packaging to check that the product is unused and the box is in perfect condition.

                           

We will not accept returns of used items as once used they lose their market value. If the product does not work properly, it will be taken to the technical service for assessment.

                           

No returns will be accepted for custom-made or made-to-order items (for example: winter covers, summer covers, custom-made swimming pools, safety fences, filters and public swimming pool equipment, hydromassage spas...) as well as spare parts,items made to order, items not published online at the time of purchase, reconditioned products or outlet area, etc.).

                           

Jarpis, S.L. reserves the right to refuse returns communicated or sent after the deadlines set or items that are not in the same condition in which they were received by the customer.

                           

Jarpis, S.L. reserves the right not to refund the full amount paid if it is considered that the product has suffered a depreciation.

                           

Jarpis S.L. will refund the amount of the product in the same way in which the payment was made, with a maximum period of 15 days from the date of return of the product as long as it is in the same condition in which it was sent.

8. WARRANTY

                           

Jarpis, S.L. guarantees its products during the first 6 months according to the current legislation, in the legally established terms, subsequently and during a period of 3 years from the date of delivery, the client will be in charge of managing the guarantee directly with the manufacturer or the service authorised by the manufacturer (excluding from this guarantee the special conditions specified by each product, according to the guarantee established by the manufacturer). Excluded from this guarantee are exclusively outlet products derived from demonstration products, which are covered by a one-year guarantee, as well as all reconditioned products that have already been used, which are covered by a one-year guarantee.

                           

Defects caused by negligence, knocks, improper use or manipulation, unsuitable voltage where applicable, or materials subject to wear and tear due to normal use are excluded from the guarantee.

                           

When the use of the guarantee is justified, we will opt for the repair, replacement of the article, discount or refund, in the legally established terms.

                           

The guarantee will lose its value in the following cases:
                           - If any of the details of the same or of the purchase invoice are modified, altered or replaced.
                           - If both the identification number and the guaranteed appliance itself are manipulated or repaired without the knowledge of the Technical Service.
                           - If the purchase invoice is missing.

                           

To make use of the warranty, it is essential to present the warranty duly stamped together with the purchase invoice. To receive the conformity of the guarantee, please contact Jarpis, S.L., either by email toinfo@piscinayspa.com. Jarpis, S.L. will be responsible for the labour costs incurred. If the necessary repair is not covered by the warranty under the terms established, the customer must bear the costs of both repair and shipping.

                           

 

                           

9. ORDER CANCELLATION

                           

You can cancel your order. If it has not yet been shipped, we will refund you the full amount.

                           

If it has already been sent, you must return your order. In this case, once we receive the goods in their original packaging and in perfect condition, we will proceed to refund the corresponding amount. However, please note that you will be responsible for the delivery and return transport costs.

10. CARD PAYMENT SECURITY

                           

Jarpis, S.L. guarantees you the utmost security and confidentiality when you shop at our shop. In a similar way to the operation you would carry out in an automatic cash machine, when you buy in Jarpis, S.L., the data referring to your credit card are encrypted using the SSL security protocol and transmitted directly to the corresponding financial entity, which is the one that accepts or rejects the payment. In this way, the information transmitted through the network enjoys total security and Jarpis, S.L. does not retain this data at any time, so it can neither view nor archive it.

                           

 

                           

11. PAYMENT BY BANK TRANSFER

                           

Jarpis, S.L. reserves the right, under certain conditions, to ask its customers to pay by bank transfer (proof of payment must be sent to info@piscinayspa.com so that the product can be dispatched quickly).

                           

 

                           

12. VERIFICATION OF PERSONAL DATA

                           

Jarpis, S.L. reserves the right to contact its customers and/or carry out certain checks when it deems appropriate, in order to guarantee the authenticity of the personal data provided.
