TERMS AND CONDITIONS OF SALE AND DELIVERY

1. VAT

All prices shown on our website include VAT in Spain. At the time of purchase, the customer must always specify if the billing details are to differ from the delivery details, for example, if the customer is a business. This must be specified at the outset, as no changes to billing details will be made after purchase other than those specified prior to the time of purchase.

Our company does not sell to businesses outside Spain, only to private individuals, as our system is fully automated and does not have an intra-Community VAT number recognition system. Consequently, all purchases made outside Spain will only be invoiced to private individuals.

2. DELIVERY CHARGES

  • Mainland Spain
    • The standard shipping cost to the mainland is €12.90. The amount will vary depending on the weight and overall dimensions of the order.

  • To the Balearic Islands
    • The standard shipping cost to the Balearic Islands is €25. The actual cost will vary depending on the weight and overall dimensions of the order.

  • In the Canary Islands, Ceuta and Melilla
    • All products sent to the Canary Islands, Ceuta and Melilla will incur a shipping charge of €145 (there will be other products for which the shipping cost will be higher depending on their weight and size)

  • In Portugal (excluding Madeira and the Azores)
    • Products priced at less than €300 will incur a shipping charge of €35.
    • There will be some special products for which, despite having a price above €300, delivery charges will apply; these will be detailed before purchase depending on the specific product. There will also be other products for which the delivery cost will be higher depending on their weight and size

  • In Madeira, the Azores, the Canary Islands, Ceuta and Melilla
    • All products shipped to Madeira, the Azores, the Canary Islands, Ceuta and Melilla will incur a shipping charge of €145

  • In the EU: France (excluding Corsica), Germany, Italy (excluding Sicily and Sardinia), Belgium, the Netherlands, Austria, the United Kingdom (excluding Guernsey and Jersey)

  • In the EU: Denmark, Sweden, Finland, Ireland, Hungary, Czech Republic, Slovakia, Romania, Poland, Lithuania, Latvia, Estonia, Slovenia

3. DELIVERY TIMES

  • Express Delivery (dispatched from our warehouse). Delivery time: 24–48 working hours, depending on location Courier Delivery.
  • Standard Delivery: 3–7 working days. Agency deliveries dispatched from the manufacturer or distributor*

*Except in cases of force majeure during the high season months of March, April, May, June and July, when the following may occur:

1. Immediate stock shortages that our system does not detect at the time of checkout. In this circumstance, the product cannot be dispatched automatically until stock is available again

2. Overwhelm at the manufacturer’s or distributor’s warehouses due to an excess of orders, including disruption at the non-courier transport agency (in this circumstance, delivery of the product may be delayed by up to 10 working days or may even be impossible)

IMPORTANT: Please ensure the goods are sent to an address where someone is always available to collect them, and that the address is correct and does not cause confusion.

Due to various factors (dimensions of the goods, value, fragility, etc.), we do not deliver to collection points, lockers, parcel boxes or any other temporary parcel collection system. Should the delivery address provided by the customer be one of the aforementioned options, JARPIS SL shall be exempt from any liability and we will not process any claims relating to the delivery.

Jarpis, S.L. shall not be held responsible for incorrect delivery to the wrong location due to: an out-of-date address, a modified address, or duplicate addresses at the same delivery address. All responsibility in this regard lies with the purchaser of the goods, who is the person who specifies the delivery address during the purchase process and who also has a field for additional notes to provide more specific details.

Once the parcels leave our warehouse, we will issue the invoice, which you will receive by email, along with the name of the courier company and your order’s tracking number.

You can also find your tracking number on our website in the ‘Track Your Order’ section by entering your email address and order number.

4. DELIVERY TIME SPECIFICATION

We recommend that you provide an address (for example, your workplace or a neighbour’s address) where there will be someone available to receive the parcel.

5. RECEIPT OF PRODUCTS

If one or more products have arrived damaged due to transport, this must always be noted on the delivery note signed for the carrier upon receipt of the order; you will then have 24 to 48 hours to report it. If the notification is not made within the specified timeframe, Jarpis, S.L. shall not be liable for any damage caused during transport.

In the event of any damage and provided it has been reported correctly and in good time, we will cover all additional transport costs that may arise, provided the product has not been used, altered or tampered with and is in its original box and seal.

Please note that in order for us to process any exchange or return, it is essential that you contact us beforehand. We will not accept any exchange or return unless we have received prior notification.

Bulky items or those requiring special handling will be delivered by the carrier to the kerbside. If special arrangements are required for delivery inside a property, onto a terrace or to specific locations, this must be requested and paid for by the customer themselves, and must be arranged externally and independently of Piscinayspa.

NOTE: Checking the goods: It is important to check the condition of your purchase upon receipt and, if you notice any damage that appears to have been caused during transport, to note this on the delivery note when signing for it.

NOTE Sales Advice: It is important to check the product’s various specifications in the user manual before ordering to ensure the product is fully suitable for its intended use. Jarpis, S.L. accepts no liability for the suitability of the product in cases where there has been a misunderstanding regarding sales advice between our agents and the end buyer.

NOTE: Excise duties. Cities and areas subject to excise duties (in the case of Spain: the Canary Islands, Ceuta and Melilla) will be taxed according to the relevant duty. This duty must be paid by the end customer or recipient of the goods in accordance with local customs laws.

6. RECEIPT OF INCORRECT PRODUCTS

If one or more products received do not match your order, we will send you the correct products or refund the corresponding amount. We will cover all additional transport costs that may arise, provided that the product has not been used, altered or tampered with and is in its original box and seal.

7. RETURNS

Right of withdrawal

You have the right to withdraw from this contract within 14 calendar days without giving any reason, provided that the product has not been used, altered or tampered with and is in its original packaging and seal.

The withdrawal period will expire 14 calendar days from the day on which you, or a third party designated by you (other than the carrier), took physical possession of the goods.

To exercise your right of withdrawal, you must notify us at the email address incidencias@piscinayspa.com of your decision to withdraw from the contract by means of an unequivocal statement, attaching the following Withdrawal Form duly completed (or, failing that, including in the email the details requested therein).

To meet the withdrawal deadline, it is sufficient for you to send the notification regarding your exercise of this right before the relevant deadline expires.

Consequences of withdrawal

In the event of withdrawal on your part, we will refund all payments received from you, excluding delivery costs, without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We may withhold the refund until we have received the goods, or until you have provided proof of their return, whichever occurs first.

You must return the goods to us or hand them over directly to the address we will provide once we have received your decision to withdraw from the contract, without undue delay and, in any event, no later than 14 calendar days from the date on which you notify us of your decision to withdraw from the contract. The deadline will be deemed to have been met if you return the goods before the end of that period. You must bear the direct cost of returning the goods. You will only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Before sending us any product for return, we require you to send us photos of the product and its packaging to verify that the product is unused and the box is in perfect condition.

Returns of used items will not be accepted, as once used they lose their market value. Should the product not function properly, it will be sent to the technical service department for assessment.

Returns will not be accepted for made-to-measure or custom-made items (e.g. winter covers, summer covers, custom-made pools, safety fences, filters and public pool equipment, hydromassage spas, etc.), as well as spare parts, items ordered on request, items not published online at the time of purchase, refurbished products or outlet items, etc.

Jarpis, S.L. reserves the right to refuse returns notified or sent outside the specified timeframes, or items that are not in the same condition as when they were received by the customer.

Jarpis, S.L. reserves the right not to refund the full amount paid if it considers that the product has depreciated in value.

Jarpis S.L. will refund the amount paid for the product using the same method of payment, within a maximum of 15 days from the date the product is returned, provided it is in the same condition as when it was dispatched.

8. WARRANTY

Jarpis, S.L. guarantees its products for the first 6 months in accordance with current legislation, under the terms established by law. Thereafter, and for a period of 3 years from the date of delivery, the customer shall be responsible for managing the warranty directly with the manufacturer or the manufacturer’s authorised service provider (excluding from this warranty any special conditions specified for each product, in accordance with the warranty established by its manufacturer). Outlet products and demonstration models are expressly excluded from this warranty and will be covered by a one-year warranty; likewise, all reconditioned products that have already been used will be covered by a one-year warranty.

Defects caused by negligence, impact, improper use or handling, unsuitable voltage where applicable, or materials subject to wear and tear through normal use are excluded from the warranty.

Where the use of the warranty is justified, the choice will be made between repair, replacement of the item, a price reduction or a refund, in accordance with the terms established by law.

The warranty will be void in the following cases:
- If any of the details on the warranty or the purchase invoice are modified, altered or replaced.
- If either the identification number or the device itself is tampered with or repaired without the knowledge of the Technical Service.
- If the purchase invoice is missing.

To make a claim under the warranty, you must present the duly stamped warranty certificate together with the purchase invoice. To obtain confirmation of the warranty, please contact Jarpis, S.L., either by email at ainfo@piscinayspa.com. Labour costs incurred will be borne by Jarpis, S.L.. If the necessary repair is not covered by the warranty under the established terms, the customer must bear the costs of both the repair and the postage.

WARRANTY TERMS &
CONDITIONS In the case of equipment located outside Spain, the costs of shipping to the technical service centre and the return shipment to the customer’s address must be borne by the customer, as the technical service warranty does not cover international postage.

9. ORDER CANCELLATION

You may cancel your order. If it has not yet been dispatched, we will refund the full amount.

If it has already been dispatched, you must return your order. In this case, once we have received the goods in their original packaging and in perfect condition, we will refund the corresponding amount. However, please note that the delivery and return shipping costs will be at your expense.

10. CARD PAYMENT SECURITY

Jarpis, S.L. guarantees the highest level of security and confidentiality when you shop in our store. Similar to a transaction carried out at an ATM, when you shop at Jarpis, S.L., your credit card details are encrypted using the SSL security protocol and transmitted directly to the relevant financial institution, which is the entity that accepts or declines the payment. In this way, the information transmitted over the network is completely secure and Jarpis, S.L. does not retain this data at any time, meaning it cannot view or store it.

11. PAYMENT BY BANK TRANSFER

Jarpis, S.L. reserves the right, under certain conditions, to request payment by bank transfer from its customers. (You will need to send proof of the transfer to info@piscinayspa.compara to ensure the product is dispatched promptly.)

12. VERIFICATION OF PERSONAL DATA

Jarpis, S.L. reserves the right to contact its customers and/or carry out certain checks when it deems appropriate, in order to guarantee the authenticity of the personal data provided.

13. LINKS TO OTHER WEBSITES

Our website contains links to other websites that we believe may be of interest to our customers. However, Jarpis, S.L. accepts no responsibility for the content that may appear on those sites.

14. CODE OF CONDUCT

The parties submit, at their discretion, to the courts and tribunals of the user’s place of residence for the resolution of disputes, waiving any other jurisdiction.

15. APPLICABLE LAW AND JURISDICTION

In general, relations with our customers arising from the provision of the services contained on our website are subject to Spanish law and jurisdiction.

Users of our website are aware of all the above and accept it voluntarily.

16. PROCESSING OF PERSONAL DATA

Jarpis, S.L. respects your right to privacy: we will only use your personal data to offer you a better service. Under no circumstances will we sell or share it with third parties. You may access, rectify or delete your data at any time. Please see our Privacy Policy here.

17. PRIVACY POLICY

In compliance with the provisions of Organic Law 15/1999 of 13 December on the Protection of Personal Data, JARPIS, S.L. informs its customers that any personal data provided will be included in an automated personal data file, created and maintained under the responsibility of JARPIS, S.L.. The purpose of this file is to facilitate the processing of orders and to send future commercial offers regarding products and services that may be of interest to our customers. JARPIS, S.L. guarantees the security and confidentiality of the data provided. As such, it undertakes to comply with its obligation of confidentiality regarding personal data and its duty to safeguard it, and to take all necessary measures to prevent its alteration, loss, unauthorised processing or use.
